Given that ocean appears to be the backdrop, Whistling Kite is far more likely - they hang out on the coast a lot, and are the same size and general colouration.
All markings are consistent with a dark morph Little Eagle (see "Birds of Prey of Australia" by Stephen Debus, or HANZAB). Whistling Kites are similar (and more common in our region) but there have been other Little Eagle sightings this year (Panboola, Mandeni, Tathra) so they are around.
