The main difference between whistling kite and swamp harrier (when perched) according to my books is that swamp harrier has a yellow eye and the kite a dark eye, plus swamp harrier legs are longer and thinner. However, this photo doesn't give us a good look at the full length of leg, or at the eyes.

I agree with the whistling kite ID:
1- It's interested in carrion, so from my reading, more likely a kite
2 - The eyes look dark and the visible lower leg looks pale (not yellow) and relatively short.
3 - No pale edged darker facial disc; General colouration looks more like a whistling kite.
